This agreement governs your use of this Website ("the Site"), please read it carefully. By using, viewing, transmitting, caching, storing or otherwise utilizing the Site, the services or functions offered in or by the Site and/or the contents of the Site in any way, you have agreed to each and all of the terms and conditions set forth below. Generally, by making a reservation on this site you enter into a contract with the hotel company itself rather than with Holiday Hotels. Please note that Holiday Hotels acts as agent only for each of the hotels to provide you with information on the hotels and an on-line reservation service. Holiday Hotel's sole responsibility to you in providing the on-line reservation service is to pass your reservation details entered on the hotel. Holiday Hotels shall not accept any liability for any loss or damage you may suffer or incur as a result of the incorrect processing of your reservation details by the hotel, or the accommodation service provided to you by the hotel. These Terms were last updated on 28th May 2002. Holiday Hotels aims to provide you with an online booking and reservation website for hotel accommodation. Unless otherwise stated to the contrary, references to Holiday Hotels are to Med Group Ltd, a company registered in England & Wales. Whose registered office is Victoria Gate, Chobham Road, Woking, Surrey, GU21 6JD, UK. This Site is operated by Med Group Ltd in accordance with the terms and conditions stated below.

Responsibility and Age

You represent and warrant that you are at least 18 years of age and possess the legal right and ability to enter into this Agreement and to use this Site in accordance with the terms and conditions herein. You agree:

1. to be financially responsible for all use of this Site (as well as for use of your account by others, including without limitation minors living with you);
2. not to assign, transfer or sublicense your rights pursuant to this Agreement;
3. to supervise all usage by minors of this Web site under your name or account;

Proprietary Rights

Information contained on the Holiday Hotels Site concerning any products and services (including but not limited to Holiday Hotel products) may only be applicable in certain areas. You acknowledge and agree that all materials contained in the Site and provided to you during your use of the Site ("Content") are the property of Holiday Hotels. You may retrieve and display Content from the Site on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) solely for your personal, non-commercial use. You agree not to copy, modify, distribute, sell or create derivative works based on any of the Content.

The Services of Holiday Hotels

Holiday Hotels provides information concerning the price and availability of hotels, together with a range of other information to assist in making a hotel reservation. Prices, restrictions and availability of goods and services may change without notice and reservations are subject to applicable taxes and fees. By completing the information boxes and clicking 'confirm' on the reservation page you are entering into a contract with Holiday Hotels for the provision of all the services of the Site, including the publication of pricing, availability and other information concerning available hotel rooms (the "Services"), on the terms set out herein. Unless otherwise agreed or specified, Holiday Hotels does not charge Users any fee for the provision of its Services. You may withdraw from your contract with Holiday Hotels for the Services at any time without any cost to you by notifying us at admin@holidayhotels.com

Content Disclaimer

The Content is intended for entertainment and information purposes only. While Holiday Hotels together with third parties who supply information which is available on the Site will make all reasonable efforts to verify that the information presented on Holiday Hotels is accurate and current, Holiday Hotels makes no express or implied warranties about the information, the services, or any other element of the Site. The views and opinions expressed on Holiday Hotels are not necessarily those of Holiday Hotels. The provision of incomplete or inaccurate information by Users may result in the delay or cancellation of reservations by Holiday Hotels. Holiday Hotels shall not be liable for transmission errors or for delays/cancellation of reservations or any other acts or omissions of featured third party providers.

Contract to purchase hotel services

Any reservations you make on this site will be directly with the company whose hotel services you are booking. At the time of making any such reservation you are entering into a contract with that company and not with Holiday Hotels. If you use the Holiday Hotels online booking facility on the Site particular terms and conditions regarding availability, prices and cancellation may apply to each rate quoted and you should read carefully the rate details that are provided before proceeding to the ["confirm" section]. Each hotel has certain rules relating to the occupancy of its rooms. Any special needs must be notified to the hotel in advance. Some hotels may have additional terms and conditions. Please note that Holiday Hotels acts as agent only for each of the hotels to provide you with information on the hotels and an on-line reservation service. User Conduct

The reservation system on the Site is provided solely to permit Users to determine the availability of services and to make legitimate reservations or otherwise transact business with suppliers, and for no other purposes. You agree to abide by the terms or conditions of purchase of any third party supplier, which are notified to you before you make such purchase. The name, address and other information (including payment data if applicable) that you provide via this Site, together with information regarding the manner in which you use this Site will be used by Holiday Hotels in accordance with the Privacy Policy. You agree not to use the Site to:

• a) upload, post or e-mail any content onto the Site
• b) transmit any material that contains software viruses or any other computer codes, files or programs or
• c) interfere with or disrupt the Site or servers or networks connected to the Site.

Indemnity

As a condition of use of this Site, you agree to indemnify Holiday Hotels its officers, agents, suppliers and other partners from and against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from (I) your use of the Site; and (ii) any material you post to or transmit through the Site including claims for Intellectual Property right infringement or defamation.

Limitation of Liability and Disclaimer

Holiday Hotels DOES NOT GUARANTEE THE ACCURACY, AVAILABILITY, TIMELINESS, COMPLETENESS, PERFORMANCE OR FITNESS FOR A PARTICULAR PURPOSE OF THE SITE OR ANY PART OF THE SITE. ALL IMPLIED WARRANTIES ARE EXCLUDED FROM THESE TERMS TO THE EXTENT THAT THEY MAY BE EXCLUDED AS A MATTER OF LAW. ADDITIONALLY, Holiday Hotels MAKES NO WARRANTY THAT THE SITE IS FREE FROM INFECTION BY VIRUSES. Holiday Hotels WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA GOODWILL OR PROFITS) ARISING IN CONTRACT, TORT OR OTHERWISE FROM YOUR USE OR INABILITY TO USE THE SITE OR ANY CONTENT THESE LIMITATIONS ARE FUNDAMENTAL TERMS OF THIS AGREEMENT AND THE SITE WOULD NOT BE PROVIDED TO YOU WITHOUT SUCH LIMITATIONS. The star ratings used on this website are determined solely by the opinions of the management of Holiday Hotels. Their opinions are based on experience, knowledge and customer feedback. Where the official rating of the hotel is known, this will be published in addition to our own star rating and it will clearly state "Official Rating".
